General Terms and Conditions for Donations

These General Terms and Conditions for Donations (hereinafter the "GTCD") apply between Terre des hommes - Aide à l'enfance dans le monde - Fondation, a foundation under Swiss law (hereinafter "Tdh"), and a natural person or legal entity (hereinafter "Donor"), via the websites accessible at https://www.tdh.org and https://www.mytdh.ch/ (hereinafter the "Website"). 

The GTCD apply in their version in force on the date the donation is subscribed to via the Website. 

The GTCD and the General Terms and Conditions of Use (hereinafter the "GTCU") apply exclusively (https://www.tdh.org/en/general-terms-and-conditions-of-use and https://www.mytdh.ch/en/general-terms-and-conditions-of-use). The Donor expressly and unreservedly accepts the GTCD and GTCU by transferring their donation. 

In the event that a User of the Website decides to create a Campaign or participate in a Campaign of a third party in the form of a donation, they certify to be of legal age. Tdh declines all responsibility if a minor makes a donation or creates a Campaign without the consent of their parents or the person with parental authority over them.

For a corporate Donor, bound by its own general terms and conditions, if these are contrary to or divergent from the GTCD, they will not be recognized, except in the case of express and unequivocal written consent on the part of Tdh, in this individual and particular case. 

Tdh reserves the right to modify these terms and conditions at any time. 

ARTICLE 1 – DEFINITIONS 

For the purpose of all GTCD, the following terms have the meanings attached to them: 

Campaign(s): Refers to any promotional campaign created by a Donor to raise funds to support one of Tdh's actions. 

Donor(s): Individuals and legal entities making one-off or monthly donations on the Website. 

User(s): Any person accessing and using the Website. 

ARTICLE 2 – Methods of payment 

Tdh accepts the following methods of payment : 

  • Direct debit (LSV) 
  • Credit cards: Mastercard, Visa, American Express 
  • PostFinance card 
  • Twint 
  • Google Pay 
  • Apple Pay 
  • Cryptocurrencies 
  • QR-Bills 
  • E-Banking to the account CH41 0900 0000 1001 1504 8 


All Donors are free to organize their own Campaigns via the Website. 

ARTICLE 3 – PURPOSE AND CONCLUSION OF THE CONTRACT 

Any donation made by the Donor binds the Donor to Tdh, whether the donation is a one-off or a monthly donation. 

The Donor is free to choose the amount of the donation they wish to make, and is deemed to have accepted the present GTCD when making the donation. 

The donation contract is concluded as soon as the transfer is credited to a Tdh bank account. 

Specific case of a monthly donation: 

When the Donor makes a monthly donation, it will be debited every month, via the payment method entered when the donation was made. 

Specific case of a donation by QR-Bills: 

Donors are free to choose the amount of their donation if they use a QR-Bill with no predefined amount. However, if the Donor uses a QR-Bill with a predefined amount, they must pay the amount mentioned. 

Withdrawal by the Donor: 

The Donor may withdraw at any time. The Donor must announce their withdrawal either by e-mail, telephone, or registered mail, no later than December 31st of the year in which the donation was made, according to the information in Article 8 - Contact. 

is specified that for a withdrawal made by registered mail, the date of withdrawal is the date of receipt of the registered mail by Tdh. 

ARTICLE 4 – USE OF DONATIONS 

If the Donor makes a donation on the Site via a sub-site on which a specific donation purpose is indicated (for example a project, a programme or a donation for humanitarian goods), Tdh will use the donation as described on this sub-site (donations earmarked for a purpose). 

In principle, Tdh is entitled to use donations freely within the scope of the foundation's purpose (donations not earmarked for a specific purpose). Tdh is certified by the ZEWO label (https://zewo.ch/), certifying that it is recognized as a charitable organization. Among other things, this label certifies that the use of donations by Tdh is controlled. 

Please note that a donation does not entitle the Donor to support specific projects or other claims. 

If the Donor makes a donation on the Website via a sub-site where a specific donation purpose is indicated (for example a project, a program or a donation for humanitarian goods), Tdh will use the donation as described on this sub-site (donations earmarked for a purpose). 

ARTICLE 5 – CORRECTION OF INPUT ERRORS 

Input errors that may occur when manually entering the amount of a donation must be reported before the end of the current fiscal year. The possibility of correcting input errors expires on December 31 of the fiscal year in which the donation was received. 

The Donor must send the correction request either by e-mail, telephone, or registered mail, according to the information in Article 8 - Contact. 

ARTICLE 6 – TAXES AND ROYALTIES 

In accordance with current Swiss tax legislation, donations to Tdh are tax-deductible under certain conditions. However, Tdh cannot guarantee that donations will be tax deductible. If a donation is not tax-deductible, this does not entitle the Donor to cancel the donation. 

For donations of CHF 20 or more, Donors receive a donation certificate from Tdh in February of the following year. If, contrary to expectations, the donation gives rise to taxes or fees due by the Donor, these are payable by the Donor. 

Minimum annual amount and tax reductions applied vary between cantons. 

ARTICLE 7 – PERSONAL DATA 

In order to make a donation, the Donor must provide personal data, such as contact details and payment details. This data, which is necessary for the operation, is stored in compliance with current regulations. 

The rules and conditions under which Tdh collects and processes this data, as well as the extent of Donors' rights, are specified in the Confidentiality Policy (https://www.tdh.org/en/privacy-policy and https://www.mytdh.ch/en/privacy-policy).

ARTICLE 9 – APPLICABLE LAW AND JURISDICTION 

The provisions of Swiss law apply exclusively to the GTCD. The application of the rules of conflict of law is excluded. 

The exclusive place of jurisdiction for all claims relating to donations is the domicile of Tdh (see Legal Notice https://www.tdh.org/en/legal-mentions and https://www.mytdh.ch/en/legal-mentions). The invalidity of any provision shall not affect the validity of the remaining provisions of the GTCD.
